More Details on the New Rules
The number of divorces thing still seems to be up in the air. Some agencies are asking and getting clarification that it is two total divorces per couple, while other agencies are being told it is two divorces per person.
All agencies (that are speaking) seem to be in agreement that the May 1st date is when dossiers must be logged in. Most agencies have a date sometime in March that dossiers must be in to their office in order for them to get them to China in time to be logged in before May 1st.
The issue of anti-depressant and anti-anxiety medication also seems to be kind of up in the air. It appears that the CCAA will decide whether the issue is severe or not based on what your doctor writes. It may be a while before we see any kind of clear guidelines from the agencies about what is okay and what is not okay.
The poll results are still hovering around 41% in the “no” category. With the number of divorces in question, and with some people who are taking anti-depressant and anti-anxiety medication possibly being okay after all, I’m guessing that we may be looking at even less than that.
As I mentioned earlier, the CCAA seems to already be applying these guidelines to new Letters of Intent for a Special Needs child. I have heard of a couple of cases of a family being denied based on too little net worth, and based on some of the medical criteria. Those who are already in the Special Needs program AND are already logged in seem to be okay. It appears to only be the new LOI applications that are being held up to the new rules. There is some talk though, that if you have a PA for a child and are not logged in yet that if you aren’t logged in by May 1st then you may lose your PA if you don’t meet the new guidelines.
Hopefully all of this will become more clear in the near future.

This is what I am trying to find out, if we can even submit an LOI on our little boy we’ve been looking at for 2 months…our agency just opened today after being closed for Christmas and I think are swamped. My husband and I each have a police record OLD police record that could prohibit us. I just need to know one way or another so I can either move on with life or move on with this adoption!!

Our dossier was sent to China last week. My husband and I do not meet the new length of marriage if there is a divorce criteria. We have been married 3.5 years not 5 as the new rules state.
If we are questioned or held up, we’ll document it here.
I think that people who are DTC or in the review rooms are going to have to share what they are questioned about or told. That is how we will learn what is really going on.
We’ll figure it out together.

Exactly. As long as people are willing to come here and share information from their experience and from their agencies, we’ll be able to put a picture together. And as long as RQ is willing to assemble these kooky puzzle pieces (screaming babe in one hand, fuzzy toy wagging in another, puzzle piece in a third. She does have 3 hands, right?).
I do wonder if in future, once the CCAA-ageny relationship deepens re. referral batches, agencies will get penalized for their clients sharing info, and if a little bit of fear of ‘what-if-they-catch-me’ will creep into what people are willing too share. Hope not! All the info that’s come has been such good prep. Even when it doesn’t come, we know there’s no info out there to be had.

Are there any new rumors as to when these referrals will be shipped/received??? I am losing my mind waiting for it… how can these few days that we have been waiting seem longer than the entire wait???

I am kinda in shock when I read that they might go back and reevaluate anti anxiety med use. That would be a BIG issue prohibiting us from going back again. I am just feeling uncertain and nervous for all of us. I don’t want to bad mouth the CCAA however I think they are toying with us a bit :( I just told my dh “Oh maybe we can go back a second time” and he told me he would love to HOWEVER this has become a real rollercoaster of emotion even for him all the uncertainty etc. He is usually the positive one too :( I told dh I will be nervous for all of us until we get our babies in our arms……….

This is my first post but have been reading for quite awhile. We have identified a waiting child that we would love to adopt but we do not fit the new guidelines due to antidepressant use (obsessive compulsive disorder). The agency we would be using is going to “ask” China about our situation before we begin so that we don’t get our hearts and pocketbooks broken if they were to reject us. I doubt it would be possible for us to get our dossier done before the deadline. I know we are taking a risk at calling attention to ourselves but we just feel we need to know one way or the other. We have a lot of positives in our favor including having adopted twice before as well as my being a nurse so we’ll see. I’ll let you know what we find out!
