One of the agencies says the package will arrive tomorrow. Haven’t heard that the other agency has said anything today.

    PLEASE PLEASE everyone check with your agency to make sure they are Hague approved and get it in writing. I just got a letter that our agency got denied approval. They can’t tell me why. They are trying to get approved but can’t guarantee it. We should be ok because we just submitted a new I-600 in Jan. and got our new approval after re-fingerprinting in March. The only thing is that we will have to go through a different accredited Hague agency to finish the adoption. We might have to pay more fees to do this.(Of course they couldn’t tell me much). I hate getting such vague, impersonal letters in the mail. I was so panicked because it sounded like the adoption might not go through. People who are so close to travel may have the most trouble because they might not have time to get another agency to act as their facilitator. This is the impression I got from our agency.

    I wanted to say too that actually someone in the Netherlands posted they received word their LOA arrived today. It was posted on the waiting for LOA list as of 6/11/08 topic. Sorry I don’t know how to link or if I could anyway to the forum. This news has me on edge as their LOI was AFTER ours. Anyway, a little news there from Europe on the SN front.

    wait4ever, I just opened the same letter. I am in a panic. i feel crushed. what do we do? How will this affect us? Why do we have to write our senators. This is their agency. This is their issue. We trusted them. I I need a glass of wine!

    Wait4ever -We’re with the same agency (got the letter today) – we’re Jan ’07 LID. This is our second adoption, which makes it a little easier to roll with the punches, but I do hope the agency gets everything worked out soon – it’s hard to wait with so many ‘what if’ questions rolling around my head!!! Hang in there.

    Wait4ever-I got that letter today as well so I imagine we’re with the same agency. The bad news just fits so well with the nightmare I had last night where I got to the window to pick up my child and they had run out! Please let me know if you hear anymore (PM). My agency location doesn’t seem to have any info. LID 2/16/06

    These lists are updated on a continuing basis – so if you do not see your agency on either list, keep checking every week or two.

    Regarding the Hague.

    Do Canadian agencies also have to be accredited with this?

    I am worried now that we are coming upon us having our file reviewed in the next few months.

    Are there usually referrals without many rumors? I am wondering if the packages are going to be TAs but we might still have a while until referrals since we have not had rumors? I have not tracked the history of this closely as others have.

    The agency was sooo vague. They sounded like they couldn’t guarentee anything. They couldn’t even tell me why they were denied accredidation and what to say even if we did write our govt. I am so confused. I checked out the links to the state dept. and there are a ton that are accredited. WHY is our not??? Will the people who are traveling in the next few weeks out of luck altogether?? If we need to switch agencies I do not have any idea how long that will take. She said we are ok because our fingerprints are good until spring. DUH!! We won’t travel next year!! We are 1-07. I am mad and confused. They need to start calling people personally instead of these stupid letters. They did the same thing last year when the rules changed and it took a day to find out if we qualified.

    It is my understanding that agencies that aren’t credited can continue to facilitate adoptions that do not fall under the Hague. Theoretically, anyone who has not let their I-171H lag who should be getting a referral anytime in the near future would not fall under the Hague.

    I’m not an expert on this one, just telling you what I’d been led to believe.

    I believe agencies can get temporary or provisional accreditation which must be renewed in a year or so…but the requirements are lower.
    I hope you agency can at least get this lower accreditation.

    I am not all that familiar with the Hague, but when my SW and I talked when I updated my HS, she mentioned that if my agency didn’t get Hague accreditation, (which at the time it didn’t..they got it on the very last day) then I would more than likely be moved to an accredited agency close to me. I don’t recall if I would get a choice in the agency, but she didn’t believe it would really effect me at referral time since it wasn’t my fault the agency didn’ t pass. I do remember her saying make sure everything stays current.

    I am sorry how people were notified, doesn’t seem very personal, I know I trust my SW and hope that everything will work out (for the better) for everyone.

    I saw on the state dept.web site that some agengies had 1 or 2 yr. accredidation. Our agency is on the denied list. Even if they manage to get this, we are LID 1-07. We might have more than 2 yrs. yet to wait. I am figuring at least mid-late 2010 if things pick up. Could we still be out of luck a year or 2 from now? I am so confused. Why would they not re-apply to get full accredidation. Would it be better to switch to a full accredidation agency if they manage to get only a year or 2??? I don’t want to stay with our agency and then realize we should have switched.

    It is my understanding that agencies do not have to have their Hague accreditation to complete adoptions that were already “in process” prior to the April 1, 2008 date.

    Here is what it says on the U.S. Dept of State website:
    4. What happens to a case that is in process when the Hague Adoption Convention enters into force with respect to the United States?

    An adoption case involving a Convention country already in process when the Convention enters into force with respect to the U.S. will not/not change into a Hague case on the day the Convention does enter into force. These transition cases will be continue to be processed in accordance with the immigration regulations for orphan adoptions which were in effect at the time the case was filed.

    There are two types of transition cases: incoming cases (where children are immigrating from another Convention country to the United States) and outgoing cases (where children are emigrating from the United States to another Convention country). The U.S. domestic implementing legislation for the Hague Adoption Convention—the Intercountry Adoption Act of 2000 (the IAA)—sets out rules for both types of transition cases.

    I know that my agency partners with another for China adoptions. My agency is now accredited, but the agency that they partner with, the one who is licensed with the CCAA, is not Hague accredited. My agency has told us that it does not matter since we started before Hague was implemented. Sure hope their right!

    I have calmed down a little since the intitial post. I had a glass of wine as soon as I got home from work. Anyway, I hope it is correct that if we keep the I-171H up to date we are ok. We are LID April 2007. I sent in our new I-600A at our agencies request so it would be pre-hague. They sent it back to us because it was before 90 days to our expiration. That was end of march. I just sent it back. I think our fingerprints will expire. I know our review sholud be coming up in the next couple of months. All this uncertainty is stressful. Like we need more stress. I only hope this all plays out positvely for all of us. I guess we can only wait. There is something we all know how to do! Thanks for listening.

    Hello everyone. I got the same letter in the mail as well today. I am slightly concerned as I have a LID 11/16/06 and we tried to update our 161A before the deadline of April 1st and it was denied. So now we need to file the new form, and I’m concerned about our outcome if we are doing this with an agency that is not accredited. And I agree, our social workers should be calling up personally, these letters suck! So I guess I now need to make a call tomorrow. I waited too long already for the agency to screw up this adoption!

    Hi Everyone!
    This morning I was so excited! I was made an American Citizen and the ceremony was so welcoming and warm hearted. We watched a lovely video and each got a welcome letter from the President. I really feel at home here now.

    I just got one of the letters about the Hague refusal and was disappointed. But its not going to ruin my night.

    Shamrock, Congratulations on becoming an American Citizen! About 3 years ago my brother in law became a Citizen and the ceremony moved me to tears.

    littleperson647: canada is a signatory to Hague, its complicated and I don’t understand it. But, the long and short of it is, this doesn’t affect us. the states have recently signed and thats why there are wrinkles to iron out.

    someone please correct me, or expand on this, but my understanding is Canada-China adoptions have been under Hague for a long time now.

    It is 2:30a.m. and that 3 weeks of sleep between getting through the review room and that stupid accredidation letter yesterday was sure nice. I guess it is back to this again. I should be used to it by now. I look at my husband who sleeps like a rock and it maks me soo mad.I wish just once he would know how it feels not to be able to sleep. Sorry, we leave for a vacation in 3 hours and I need to vent a little. The agency sure sends these letters at the worse time. Waitingforthegirl,please let us know what the agency tells you. I think they need to schedule a meeting in person for all families and answer questions.

    W4E- I am so sorry that you are going through this. I went through a similar scare a few weeks back when it looked like our i600 was botched – I was freaking out because we should be getting our referral this month but it did all work out. Believe me when I say that I would be reacting just like you if in your shoes. That said, knowing that there are so many people dealing with the same issue would give me some comfort and confidence that this will all work out. Go now and have a great vacation and try not to worry. I once read something that really stuck in my head – it said “Worrying does not rob tomorrow of its challenges but rather saps today of your strength” or something like that and it just rang so true to me. I hope it helps!

    I think Canada has to abide by the Hague, but you really need to talk to your agency. This link lists Canada’s status.

    I believe that the Hague agreement, like many international treaties, has varying levels of membership, but here is a link to a site that lists those countries participating in the international patent portion of it: http://www.wipo.int/members/en/

    The original agreement was in 1925, the latest addendum made was 1999. It is primarily a trade agreement, but much like being in the EU, you can’t trade unless other things in your country are in line.
